AeroTycoon Terms of Service
1. General
- These Terms govern the use of the AeroTycoon mobile game (the “Game”), including purchases of paid content.
- The Game is provided by VXN Marcin Gański, ul. Myśliwska 33F lok. 125, 80-283 Gdańsk, Poland, tax ID (NIP) 589-188-66-04, REGON 221944780 (the “Operator”). Contact: support@aerotycoon.pl.
- How we process personal data is described in the Privacy Policy.
- Definitions: Account – a player account created with an email address; Airline – the player's virtual airline; Game currency – virtual money earned in the Game; Premium points – virtual points earned in the Game or purchased; Paid content – Premium points, the auto dispatcher subscription and the premium season pass.
2. Requirements and Account
- To play you need an iOS or Android phone, internet access and an email address.
- The Game is intended for people aged 16 or over; younger people may play with the consent of a parent or guardian.
- Creating an Account is free. By creating one you enter into an agreement with the Operator for the provision of electronic services for an indefinite period.
- You must use an email address you have access to and must not share your password. Accounts may not be sold or transferred.
- You may delete your Account at any time in the app (Settings → Delete account). Deletion is permanent: your Airline, Game currency and unused Premium points are lost.
3. Gameplay
- All players share one world: passengers on routes, the aircraft market, auctions and the stock market. The Game runs on the server in real time (UTC), also while the app is closed.
- Your Airline's results depend on your decisions and on other players. The Operator does not guarantee in-game profits.
- If your Airline's balance is negative, the bankruptcy procedure starts: after 48 hours the fleet is grounded, and after another 72 hours the Airline restarts with starter equipment. On restart, the fleet, hubs, finances, research and Premium points earned in the Game are lost; your Account, Airline name and purchased Premium points remain.
- The Operator may change game rules and parameters (e.g. prices, demand, rewards) and add or remove features to keep the Game balanced and develop it. Such changes will not alter the price or scope of Paid content you have already bought to your disadvantage.
4. Code of conduct
It is prohibited to:
- use programs that automate gameplay (bots), modify the app or interfere with its communication with the server;
- exploit Game bugs for advantage – please report bugs to the address in section 1;
- run multiple Accounts to gain an advantage, e.g. to transfer Game currency or manipulate the stock market, auctions or the aircraft market;
- sell or buy Accounts, Game currency or Premium points outside the Game;
- use Airline names or chat messages that are offensive, vulgar, hateful, infringe others' rights, contain personal data or advertising;
- harass other players or send spam.
For violations the Operator may remove content, rename the Airline, reverse benefits gained from the violation and, for serious or repeated violations, suspend or delete the Account (section 8).
5. Paid content
- You can buy Premium point packs, a monthly auto dispatcher subscription and the premium season pass for the current season. Current prices are shown in the app before purchase.
- Payments are handled by Apple (App Store) and Google (Google Play) under their terms. The Operator never receives payment details.
- Premium points can only be used for Game features (e.g. speed-ups, slots, hubs, the dispatcher). They have no monetary value and cannot be exchanged for money or transferred to another Account.
- The subscription renews automatically every month until you cancel it in App Store or Google Play settings. Deleting your Account does not cancel the subscription.
- Paid content is supplied immediately after purchase. A consumer who agreed to immediate supply and acknowledged the loss of the right of withdrawal loses that right (in the EU: Art. 16(m) of Directive 2011/83/EU). This does not limit your rights if digital content does not conform to the contract.
- You may also request a refund directly from Apple or Google under their rules.
6. Availability and liability
- The Operator works to keep the Game running, but technical breaks may occur, including planned maintenance. Where possible, the Operator announces them in advance.
- The Operator is not liable for interruptions beyond its control (e.g. network or app store outages, force majeure) or for the consequences of a player sharing their password.
- If Paid content is not delivered or does not work due to the Operator's fault, the Operator will deliver it, restore it or credit its equivalent in Premium points; your statutory consumer rights remain unaffected.
- The Operator will announce the end of the Game at least 30 days in advance and stop selling Paid content at that time.
7. Complaints
- Complaints about the Game can be sent to the email address in section 1. Please include your Account email, Airline name and a description of the problem.
- The Operator replies to complaints within 14 days.
- Consumers may use out-of-court dispute resolution, e.g. consumer ombudsmen or consumer protection authorities in their country.
8. Suspension and termination
- You may terminate the agreement at any time by deleting your Account.
- For a violation of these Terms the Operator first asks the player to stop, unless the violation is serious (e.g. fraud, bots, unlawful content). If the request is ignored or the violation is serious, the Operator may suspend the Account or terminate the agreement with 7 days' notice, or with immediate effect for a serious violation.
- You may appeal a suspension to the address in section 1; appeals are handled within 14 days.
9. Intellectual property
- The Game and its elements are protected by copyright. You receive a non-exclusive, non-transferable licence to use the Game for personal purposes.
- Names of manufacturers, aircraft models and airports are used only for realism and belong to their owners. The Game is not affiliated with any manufacturer, airline or airport.
- In-game map: © OpenStreetMap contributors, ODbL licence.
- You grant the Operator a licence to display content you create in the Game (Airline name, chat messages) to other players for as long as your Account exists.
10. Changes to these Terms
The Operator may change these Terms for valid reasons (e.g. changes in law, new features, security). Changes are announced in the app at least 14 days before they take effect. If you do not accept them, you may delete your Account before that date.
11. Final provisions
- The agreement is governed by Polish law. This does not deprive consumers of the protection of mandatory laws of their country of habitual residence.
- Disputes with consumers are resolved by the courts having jurisdiction under general rules.
- These Terms are available in the app and at this address.
